IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS (“OFFICIAL RULES”) BEFORE NOMINATING SOMEONE, OR YOURSELF, FOR THE “HEALTHCARE HEROES VEGAS” (THE “CONTEST”) PRESENTED BY HEALTHCARE HEROES FOUNDATION. BY NOMINATING SOMEONE, OR YOURSELF, FOR THE CONTEST, A NOMINEE MUST REPRESENT THAT HE OR SHE SATISFIES ALL OF THE ELIGIBILITY REQUIREMENTS IN SECTION “ELIGIBILITY” BELOW AND AGREES TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES AND ALL DECISIONS OF HEALTHCARE HEROES VEGAS WHICH ARE FINAL WITH RESPECT TO ALL MATTERS RELATING TO THE CONTEST.
Contest Period
The Contest begins on April 10th, 2020 at 8:00 a.m. (PST) and ends on June 30th, 2020 at 11:59 p.m. (PST). The date and time of the reception of the nominees will be taken as a proof of eligibility to the contest.
Eligibility
NO DONATION OR PURCHASE NECESSARY TO ENTER OR WIN. This Contest is open to U.S. residents only, who work in the healthcare industry and are generally considered a frontline employee dealing with the COVID-19 pandemic. This includes, but is not limited to, nurses, doctors, emergency medical technicians, ambulance drivers, nursing home staff members, certified nursing assistants, licensed practical nurses, registered nurses, phlebotomists, radiologists, pulmonary specialists, medical lab workers, billing assistants, and other staff members of hospitals, nursing homes, and medical facilities tasked with treating COVID-19 patients.
How to Enter
To nominate someone, or yourself, for the contest, participants must visit healthcareheroescruise.com. They must then follow the instructions to nominate someone, or themselves, using the form on the website. The nominee will then be entered into the drawing. Each winner will be verified before being awarded with any prize.
Individuals can only be nominated once. All other entries for that nominee will be discarded. Participants must respect these limits or the nominee could be disqualified.
Chances of winning depend on the number of eligible nominees. Healthcare Heroes Foundation will award as many vacation or cruise packages (“The Prize”) as possible with the money raised. Very minimal administration costs will be deducted and may include website maintenance costs and legal review. No purchase or donation necessary to participate or win.

Any prize awarded shall be selected by the Healthcare Heroes Foundation in its sole discretion and may vary from photos used in advertising or promotional materials (including, but not limited to, print advertising, the Site and electronic and web banner advertising). No prize may be redeemed for cash or transferred. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). No prize substitutions allowed, except at the Healthcare Heroes Foundation’s sole discretion. If for any reason a prize cannot be awarded as described in these Official Rules, a prize of equal or greater value may be substituted by Healthcare Heroes Foundation in its sole discretion. ALL WINNERS ARE SOLELY RESPONSIBLE FOR USE OF THEIR PRIZES.
Terms and conditions:
All fees or expenses must be borne by the winner and/or his guests, including without limitation transportation, meals, drinks (alcoholic and non-alcoholic), hotel, tips and taxes, personal insurance, Internet access fees, local and international telephone calls, all other personal expenses;
All winner’s guests must sign a declaration and release form (the “Declaration Form”) provided in accordance with these Contest Rules and confirm therein that they comply with the rules as provided herein.
Winners selection
The number of winners drawn will be dependent on the amount of donations received. Once the final donation amount is calculated, the best price of the winners’ package will be negotiated through International Cruise and Excursions, Inc. (ICE), 7720 N. Dobson Road, Scottsdale, Arizona 85256. International Cruise and Excursions will be the sole vendor for arranging the travel packages. The winners will be drawn at approximately 5:00 p.m. (PST) on July 1st, 2020.
If the random winners cannot be reached within five (5) business days following the selection of the winner or if the Healthcare Heroes Foundation determines (in their sole discretion) that the selected winner does not meet all of the Contest conditions described in these Official Rules, another draw will be made among eligible participants. This process will be repeated until all selected eligible winners are declared. To be declared a winner, a selected nominee entrant must sign and return a standard form Declaration and Waiver confirming his or her acceptance and compliance with these Official Rules and releasing the Healthcare Heroes Foundation, and their affiliates, and each of their respective employees, directors, officers, governors, affiliates, representatives, parent companies, subsidiaries, professional advisors, and advertising and promotional agencies (collectively, the “Released Parties”) from any and all liability arising out of, pursuant to, or as a result of the carrying out of the Contest, including, without limitation, liability arising from the acceptance of and usage of the prizes as awarded, the administration of the Contest and the selection of the winner. The winners and their guest must sign the Declaration Form that they will receive from the Contest Organizers by email on the same day and return a scanned copy to the Contest Organizers within five (5) business days of its receipt.
Failure to comply with the terms above mentioned or any of the terms and conditions mentioned in these Contest Rules will result in the disqualification of the nominee selected for the prize. In such a case, the Contest Organizers may, at their sole discretion and time permitting, hold a new random draw among the other nominees in accordance with these Contest Rules to declare a new winner.
Ownership of Entries
All entries and materials submitted to the Healthcare Heroes Foundation and their affiliates, in connection with the Contest (collectively, ” Entry Materials”), along with all copyright, trademark and other proprietary rights associated therewith, become the property of the Healthcare Heroes Foundation, and their affiliates upon submission, and Entry Materials will not be returned to any entrant. All nominees agree to take, at the Healthcare Heroes Foundation, and their affiliates’ expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by the Healthcare Heroes Foundation, and their affiliates to effect, perfect or confirm the Healthcare Heroes Foundation, and their affiliates’ ownership rights as set forth above in this Section.
Use of Personal Information and of Winner’s Name, Likeness, Etc.
By participating in the Contest, each winner consents to the collection, use and disclosure of his or her personal information by the Healthcare Heroes Foundation, and their affiliates for the purposes of administering the Contest, awarding prizes and announcing the winner. Except where prohibited by law, by entering the Contest, all nominees hereby grant to the Healthcare Heroes Foundation, and their affiliates the unlimited right (but not the obligation) to publish and use, without payment or other compensation and without notice, consent or approval, his/her name, photograph and likeness, voice, and the whole or part of any statement or statements he/she has made or makes about the Contest or a prize in any publicity, program or advertising, without geographic limit and in perpetuity, in any medium now known or hereafter devised (including, without limitation, the Internet), and hereby consents unconditionally to any such publication or use without further notice, consent, approval or compensation.
GENERAL RULES
Verification. Electronic entry forms and Declaration Forms are subject to verification by the Contest Organizers. Any entry form which is, as the case may be, incomplete, illegible, mutilated, fraudulent, registered or submitted late, bearing an invalid e-mail address or phone number, or otherwise noncompliant shall be rejected.
Disqualification. The Healthcare Heroes Foundation, and their affiliates reserve the right to disqualify any entrant and void any entries of that entrant who it believes has tampered with the entry process or any other component of the Contest, whose conduct or action may affect the administration, security or fairness, integrity or proper conduct of the Contest, or who fails to meet or abide by these Official Rules.
Contest rollout. Any attempt by any person to tamper with the entry process, to interfere with the proper administration and enforcement of these Official Rules or the Contest, to deliberately damage the Site or any other website may constitute a violation of law, and Healthcare Heroes Foundation, and their affiliates reserve the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law
Prize acceptance. The prize must be accepted as it is described in the present rules and cannot in any case be in totality or in parts transferred to another party, substituted for another prize or traded against money, while respecting the following paragraphs.
Prize substitution. In the eventuality where it would be impossible, difficult and/or more expensive for the contest organisers to give a prize (or part of a prize) as it is described in the present rules, they reserve the right to give a prize (or part of a prize) of same nature and of equivalent value.
Limitation of responsibility: use of the prize. By entering the Contest, each nominee and/or winner agrees to fully indemnify and hold harmless the Contest Organizers; the Healthcare Heroes Foundation, or their respective agents, affiliates, subsidiaries, related companies, their advertising and promotional agencies, their employees, agent or representative against any and all liability, damages or causes of action with the prize acceptance or the use of the prize.
Website function. The contest organizers in no way guarantee that the contest website or any related website will be accessible or functional without interruption during the contest period or that it will be free of errors.
Limitation of responsibility: contest operation. The beneficiaries are not liable for any faulty computer components, software, or line of communication, or for the loss or absence of network communication capability, or for any faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult or render an individual unable to enter the contest. As well, the Released Parties are not liable for any damage or loss that may be caused, directly or indirectly, in whole or in part, by the loading or downloading of any webpage, software, or other item or the transmission of any information with a view to participating in the contest.
Modification of the contest. The contest organizers reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend this contest in whole or in part should human intervention or an event take place that could modify or affect the administration, security, impartiality, or conduct of the contest as provided herein, subject to applicable state and federal laws.
End of contest entry. In the event that the computer system is unable to register all contest entries during the contest period, for any reason whatsoever, or contest entry must end in whole or in part before the date indicated herein, winners may be drawn, at the discretion of contest organizers, from among the entries duly registered during the contest period or, where applicable, up to the date of the event that put a stop to contest entry.
Prize limit. In no case will contest organizers be required to award more prizes than set forth herein, or award a prize other than as specified herein.
Limitation of liability: contest entry. By entering or attempting to enter this contest, all persons entering or attempting to enter this contest release the beneficiaries of all liability for any damage they may suffer by entering or attempting to enter the contest.
Authorization. By taking part in this contest, any nominee selected for a prize authorizes the contest organizers and their representative to use, if required, their name, photograph, likeness, voice, state of residence, and/or statement about the prize for advertising purposes without compensation of any kind.
Communication with entrants. No communication or correspondence will be exchanged with entrants as part of this contest other than in accordance with these rules or at the initiative of contest organizers.
Property. Documents used for the Contest such as the declaration form are the property of the Contest Organizers and shall not, in any case, be returned to entrants.
Entrant identification. For the purposes of these rules, the nominee is the person whose name is entered in the “name of nominee” field on the contest website entry form. This is the person who will be awarded the prize if selected and declared a winner.
Decisions by the contest organizers. Any decision by the contest organizers or their representatives regarding this contest is final and binding, subject to any decision by applicable courts located in Clark County, Nevada.
Disputes. The jurisdiction for all disputes shall be Clark County, Nevada where the Healthcare Heroes Foundation is located.
Severability. If a section of these rules is declared or deemed illegal, unenforceable, or invalid by a court of competent jurisdiction, that section will be considered null and void, but all other sections that are not affected will be enforced to the extent permitted by law.
